These Terms of Sale govern the purchase of premium access, subscriptions, and other paid digital services offered through Nicky.xxx (the “Service”). By purchasing any paid service from Nicky.xxx, you agree to be bound by these Terms of Sale.

The Service is intended exclusively for adults. You may only purchase or use paid services if you are at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher. Unless expressly stated otherwise, all paid content is provided in digital form only and is accessible online through your browser. No physical products are shipped. No download rights are granted unless explicitly stated on the relevant offer page.

Automatic renewable subscriptions can be cancelled at any time at no cost, the buyer will keep the unlimited access for the time paid. To cancel a subscription, a button "Cancel my subscription" will appear on your user profil page.

Illimited accesss is delivered immediately after your payment has been accepted.

Currencies accepted are euros (EUR), dollars (USD) and pounds (GBP).

Payments for paid services may be processed by third-party payment providers, including Epoch and CentralPay, depending on the offer or checkout flow presented to you.

By submitting payment information, you agree to the terms, conditions, and privacy policies of the applicable payment provider. We do not control the independent operation of third-party payment providers and are not responsible for their services, interfaces, or policies, except as required by applicable law.

We do not store your full payment card details on our own systems when payments are processed through third-party payment providers.

Your order is considered accepted once payment has been successfully authorized and confirmed by the applicable payment provider.

Access to paid digital content is generally granted immediately after successful payment. In some cases, access may be delayed for technical, verification, fraud prevention, or payment-processing reasons.

You are responsible for ensuring that the email address, payment details, and account information you provide are accurate and up to date.

If you purchase a monthly premium subscription, your subscription will renew automatically at the end of each billing period unless you cancel it before the next renewal date.

By purchasing a monthly subscription, you authorize the applicable payment provider to charge the recurring subscription fee using your selected payment method at each renewal period until cancellation.

The amount charged at renewal will be the price stated at the time of purchase, unless otherwise disclosed to you in advance in accordance with applicable law.

If you purchase annual premium access, your access is granted for the fixed period stated at the time of purchase.

Unless expressly stated otherwise at checkout, annual access does not renew automatically. At the end of the applicable term, your premium access will expire unless you purchase a new plan.

Monthly subscriptions must be cancelled through the applicable payment provider that processed your subscription, such as Epoch or CentralPay, using the tools, links, or customer support channels made available by that provider.

Cancellation will generally stop future renewals but will not retroactively cancel charges already processed for the current billing period.

Unless otherwise required by law, cancellation of a subscription does not entitle you to a partial refund for the unused portion of the current billing period.

If you experience difficulties cancelling through the payment provider, you may contact us at admin@nicky.xxx, and we will use reasonable efforts to assist you, without replacing the provider’s own cancellation procedures.

By purchasing digital content or digital services that are made available immediately after payment, you expressly request immediate performance of the service.

To the extent permitted by applicable law, and in particular where the laws of the European Union or similar laws apply, you acknowledge that once immediate access to digital content or digital services has begun, you may lose any statutory right of withdrawal that would otherwise apply.

Where mandatory consumer protection laws provide rights that cannot be excluded, nothing in these Terms of Sale limits those mandatory rights.

Due to the digital and immediately accessible nature of the Service, purchases are generally non-refundable once access has been granted, except where required by applicable law.

However, we may review refund requests in exceptional circumstances, including but not limited to verified technical failures, duplicate charges, payment errors, or fraudulent transactions.

Any voluntary refund granted in a particular case does not create an obligation to grant refunds in other cases.

The Service is provided on a browser-access basis and requires a compatible device, a supported browser, and an active internet connection.

We do not guarantee uninterrupted or error-free availability of the Service. Access may occasionally be suspended, limited, or affected by maintenance, technical issues, network problems, security incidents, or factors beyond our reasonable control.

You agree not to misuse the Service. In particular, you may not:

Share your account credentials with third parties;

Attempt to bypass payment, subscription, age, or access restrictions;

Copy, reproduce, record, scrape, redistribute, resell, or commercially exploit any paid content except as expressly authorized;

Use the Service in violation of applicable laws or regulations;

Attempt to interfere with the proper operation or security of the Service.

We reserve the right to suspend or terminate access in the event of suspected abuse, fraud, unauthorized sharing, or breach of these Terms of Sale or other applicable terms.

All content made available through the Service, including games, text, images, video, branding, interfaces, and audiovisual elements, is protected by intellectual property laws and remains the property of and/or its licensors.

Your purchase grants you a limited, personal, non-exclusive, non-transferable, and revocable right to access the paid content for your own private use during the applicable access period. No ownership rights are transferred to you.

To the fullest extent permitted by applicable law, Nicky.xxx and shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or in connection with the purchase or use of the Service.

Nothing in these Terms of Sale excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer rights.

If a payment is reversed, charged back, disputed without valid reason, or identified as fraudulent, we reserve the right to suspend or terminate the related account or premium access, without prejudice to any other legal remedies available to us.

We also reserve the right to request reasonable information to verify identity, prevent fraud, or investigate suspected abuse.

The Service is offered internationally. However, you are solely responsible for ensuring that your purchase, access to the Service, and viewing of adult content are lawful in your country, state, province, or other jurisdiction.

We reserve the right to restrict access to the Service in certain jurisdictions if necessary for legal or operational reasons.

These Terms of Sale may be made available in multiple languages, including English and French. In the event of inconsistency or conflict between language versions, the version designated by us as controlling, or failing that, the English version, shall prevail to the extent permitted by applicable law.

We may update these Terms of Sale from time to time for legal, technical, operational, or commercial reasons. The version in force at the time of purchase will apply to that purchase, unless a change is required by law or expressly accepted by you where applicable.

These Terms of Sale are governed by the laws of France, without prejudice to any mandatory consumer protection rights applicable in your country of residence.

Any dispute relating to the interpretation, validity, or performance of these Terms of Sale shall be subject to the jurisdiction of the competent courts, unless otherwise required by mandatory law.
